These Terms & Conditions (“Terms”) govern your access to and use of Splannes Mail, a business email hosting service operated by Splannes (“Splannes”, “we”, “us”, “our”). By creating an account, publishing DNS records for our service, or using Splannes Mail, you (“you”, the “Customer”) agree to these Terms. If you do not agree, do not use the service.
1.The service
Splannes Mail provides multi-tenant business email hosting: mailboxes, aliases, distribution lists, domain and DNS guidance, anti-spam filtering and related tools, delivered over standard protocols (SMTP, IMAP, POP3) with TLS. Features and limits may vary by plan and may change over time.
2.Accounts & registration
- You must provide accurate registration information and keep it up to date.
- You are responsible for all activity under your account and for keeping passwords and API keys confidential.
- You must own or be authorised to use any domain name you add to the service.
- You must be able to form a binding contract and not be barred from receiving the service under applicable law.
3.Free trial & billing
- Free trial: new companies receive a 30-day free trial. No charge is made during the trial.
- Pricing: after the trial, service is billed monthly per mailbox. Current plans are Starter (TZS 1,000), Business (TZS 9,500) and Enterprise (TZS 15,500) per mailbox per month. Prices are in Tanzanian Shillings and may be updated on notice.
- Payment: payments are processed through ClickPesa (M-Pesa, Airtel Money, Halopesa, Mixx by Yas and other supported methods). You authorise us to charge the amounts due for your mailboxes each billing cycle.
- Non-payment: invoices unpaid past the due date and grace period may lead to suspension (see §6). Fees already paid are non-refundable except where required by law.
- Taxes: stated prices may be exclusive of any applicable taxes or levies, which are your responsibility.
4.Acceptable use
You agree not to use Splannes Mail to:
- send unsolicited bulk or commercial email (spam), or operate mailing lists without proper consent;
- send phishing, malware, fraudulent, deceptive, harassing, hateful or unlawful content;
- infringe intellectual-property or privacy rights, or violate any applicable law or regulation;
- forge headers or sender identities, or relay mail for third parties without authorisation;
- attempt to gain unauthorised access to, disrupt, or overload the service or other users; or
- resell the service without our written agreement.
We may throttle, filter, or block traffic that threatens the security, reputation or stability of the platform.
5.DNS & deliverability
Correct email delivery depends on DNS records you publish at your domain registrar (MX, SPF, DKIM, DMARC and, where applicable, an A record and PTR). We provide the exact values and step-by-step guidance in the console (see the FAQ section). You are responsible for publishing and maintaining these records. We do not guarantee delivery to, or acceptance by, third-party mail providers, which apply their own filtering and reputation rules.
6.Suspension & termination
- We may suspend or terminate access for non-payment, breach of these Terms, or activity that endangers the platform or others.
- Where practical we will give notice; urgent security or abuse matters may require immediate action.
- You may stop using the service at any time. On termination, access to mailboxes and stored mail may be disabled and data may be deleted after a reasonable period.
- We recommend you keep your own backups of important email.
7.Data & privacy
- We process account and email data only to provide and secure the service, handle billing, and meet legal obligations.
- We do not sell your data. Email content is private to your organisation; our staff access it only where necessary to operate the service, comply with law, or with your consent.
- Sub-processors (e.g. ClickPesa for payments, and infrastructure providers) process data on our behalf under appropriate safeguards.
- We apply reasonable technical and organisational measures to protect data, but no service is perfectly secure.
- We handle personal data in line with the Tanzania Personal Data Protection Act, 2022 and other applicable law. You are the controller of the personal data in your mailboxes and must have a lawful basis for processing it.
8.Availability & support
We aim for high availability but do not guarantee uninterrupted service. Maintenance, updates or events beyond our reasonable control (including network, power or upstream provider failures) may affect availability. Support is provided by email at support@splannes.co.tz.
9.Limitation of liability
To the maximum extent permitted by law, Splannes is not liable for indirect, incidental, special or consequential losses, or for loss of profits, revenue, data or goodwill. Our total aggregate liability arising out of or relating to the service is limited to the fees you paid to us for the service in the three (3) months preceding the event giving rise to the claim. The service is provided “as is” and “as available” without warranties of any kind except those that cannot be excluded by law.
10.Changes to the service or these Terms
We may update these Terms or the service from time to time. Material changes will be notified through the console or by email. Continued use after changes take effect constitutes acceptance of the updated Terms.
11.Governing law
These Terms are governed by the laws of the United Republic of Tanzania, and the courts of Tanzania have jurisdiction over any dispute, without prejudice to any mandatory consumer protections available to you.
